Distance Sales Agreement

This agreement governs the rights and obligations of the parties regarding the sale and delivery of products ordered electronically by the Buyer through the Seller’s website esilamarket.com, in accordance with the provisions of Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

The type, quantity, number of items, sales price including VAT, applied coupon, payment method and Esila Puan discounts, shipping fee and total amount are set out in the order summary and the order confirmation email sent to the Buyer: Completed when the order is placed

• All prices are in Turkish lira and include VAT.
• Bank transfer / EFT: If the Buyer wishes, they may pay the order amount by bank transfer to the Seller’s bank account shown on the order confirmation page and in the order confirmation email, entering the order number in the reference field. If the payment does not reach the Seller’s account within 48 hours, the order is cancelled and the Buyer is not charged. Products are dispatched after the payment reaches the Seller’s account.
• Payment method discounts: At the rates valid when the order is placed, a discount of 5% for bank transfer, 0% for card payment and 0% for pay on delivery is applied to the product amount (after any coupon discount; excluding the shipping fee and the pay on delivery service fee). A method with a 0% rate has no discount. The applied discount is shown separately in the order summary and in the order confirmation email.
• The standard shipping fee is ₺0; shipping is free if the cart total after coupon discounts (before any payment-method discount) is ₺1,000 or more.
• Payment is taken by credit or debit card using 3D Secure authentication. Instalment options are subject to the card-issuing bank’s terms.
• Pay on delivery: If the Buyer wishes, they may pay the order amount to the courier when receiving the product, in cash or by credit card (using the courier’s POS terminal). The pay on delivery service fee is ₺0 and is added to the order total; pay on delivery is available for orders of ₺15,000 or less. For pay on delivery orders, payment is collected upon delivery; orders that are not accepted are cancelled and no payment is requested from the Buyer. Refunds for purchases made using pay on delivery are issued by bank transfer to the account specified by the Buyer.
• The price displayed on the website is the price valid at the time of ordering; it is not changed after the order is confirmed.

• Products are sent to the delivery address specified by the Buyer via a courier company. The delivery period may not exceed the statutory maximum of 30 days from order confirmation. Target dispatch time: 1–2 business days
• If delivery is made to someone other than the Buyer, the Seller is released from liability; the recipient is deemed to have received the products on the Buyer’s behalf.
• If a package appears damaged upon delivery, it is recommended that the courier be asked to draw up a damage report.
• If performance of the obligation becomes impossible for reasons such as the product being out of stock, the Seller will notify the Buyer within 3 days and refund the amount collected within 14 days at the latest.

The Buyer has the right to withdraw from the agreement within 14 days from the date they receive the product, without giving any reason or paying any penalty. For orders consisting of multiple products, this period begins on the day the last product is received.

Notice of withdrawal may be sent by email to bilgi@esilamarket.com or submitted in writing. The Seller will refund the product price and any delivery costs using the original payment method within 14 days of receiving the notice. The product must be sent to Esila Bitkisel Sağlık Ürünleri · Bekbele Mah. 65. Menderes Sk. No: 7 A, İskenderun / Hatay within 10 days of the notice.

Under Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised in the following cases:

• Products whose wrapping, tape, seal or packaging has been opened after delivery and which are unsuitable for return for health and hygiene reasons (e.g. opened creams, oils, herbal pastes, food and cosmetic products),
• Products that are perishable or may pass their expiry date,
• Products prepared according to the Buyer’s requests or personal needs,
• Products that become mixed with other products after delivery and cannot be separated due to their nature.

If a delivered product is defective, the Buyer may exercise one of the rights set out in Article 11 of Law No. 6502: rescission of the agreement, a price reduction, repair free of charge or replacement with a non-defective equivalent. The cost of returning a defective product is borne by the Seller.

• The Buyer acknowledges that they have read the Pre-contractual Information Form and provided the necessary electronic confirmation before confirming the order.
• If it is established that the card was used without the Buyer’s consent, the amount collected will be refunded by the relevant bank or payment institution.
• The contract is concluded electronically when the Buyer confirms the order, and a copy is sent to the Buyer’s email address. The Seller retains the contract text for at least 3 years.

For disputes arising from this contract, the Consumer Arbitration Committees at the Buyer’s place of residence or the place where the transaction took place have jurisdiction within the monetary limits announced annually by the Ministry of Trade; for amounts exceeding these limits, the Consumer Courts have jurisdiction. Applications may also be submitted via the Consumer Information System (TÜBİS) through e-Devlet.
